Rehabilitation of offenders act 1974

1. The main provisions of this Act allow certain convicted persons who have not been subsequently re-convicted to consider their conviction as ‘spent’. The general effect of this is that under most circumstances no reference needs to be made to such conviction or circumstances relating to it by the person concerned, nor should any other person publish it or refer to it. 

2. Because of the nature of the work for which you are applying, this post is exempt from the provisions of section 4 (2) of the rehabilitation of offenders act 1974 by virtue or rehabilitation of offenders act (exemptions) order 1975. 

3. Applicants are, therefore, not entitled to withhold information about convictions which, for other purposes, are ‘spent’ under the provisions of the act. 

4. In the event of employment, any failure to disclose convictions or cases pending could result in dismissal or disciplinary action by the Hospice. 

5. Any information given will be completely confidential and will be considered only in relation to your application to which the order applies.
